Terms of Service

Thank you for using Pixeltrace. We built it to help you finally see what your users do inside your Flutter web app. Because we cannot know every customer personally, we put in place these Terms of Service to keep things fair and clear.

When we say "Company", "we", "our", or "us", we mean Pixeltrace.dev. When we say "Services", we mean pixeltrace.dev and any product we create and maintain, including the Pixeltrace session-recording SDK and dashboard, whether delivered in a web browser, an SDK, or another format. When we say "you" or "your", we mean the people or organizations that hold an account with, or join the waitlist for, one or more of our Services.

We may update these Terms in the future. Whenever we make a significant change, we will refresh the date at the top of this page and take other appropriate steps to notify account holders. When you use our Services, now or in the future, you agree to the latest Terms. If at times we do not enforce a provision of the Terms, that does not mean we waive it. These Terms do contain a limitation of our liability.

Account terms

  1. You are responsible for maintaining the security of your account and password, and for ensuring your users do the same. The Company cannot and will not be liable for any loss or damage from your failure to keep your account secure.
  2. You are responsible for all content posted to, and activity that occurs under, your account, including content posted and activity by any of your users.
  3. You must be a human. Accounts registered by bots or other automated methods are not permitted.
  4. You must be at least 16 years old to use the Services or to submit your email address or any other personal information to us, including by joining the waitlist.
  5. You may not use the Services for any unlawful or abusive purpose, and you may not permit your users to do so either.

The waitlist

Pixeltrace is not generally available. Joining the waitlist places no obligation on either of us: you are not buying anything, and we are not promising a launch date, specific features, or that you will receive access. We will use the email you provide to tell you about availability and product news, and you can unsubscribe at any time.

Payment, refunds, and plan changes

These terms apply once paid Services are available to you.

  1. If a Service offers a free trial, we explain its length when you sign up. After the trial, you must pay in advance to keep using the Service; if you do not, we may freeze and later cancel the account.
  2. For upgrades and downgrades in plan level, any new rate takes effect from the next billing cycle unless we state otherwise at the time.
  3. All fees are exclusive of taxes, levies, or duties. Where required, we will collect and remit applicable taxes; otherwise you are responsible for them.
  4. Our refund policy is simple and fair. If you cancel a paid plan before the end of your current paid-up month, your cancellation takes effect immediately and you will not be charged again. We do not automatically prorate unused time in your last billing cycle. If you forgot to cancel a plan you no longer use, or you were billed for a renewal you did not intend, email us at support@pixeltrace.dev and we will do right by you. We would rather refund a charge you regret than keep money you did not mean to spend.

Cancellation and termination

  1. You are solely responsible for properly canceling your account. We provide a way to cancel within the Services or by contacting us at support@pixeltrace.dev.
  2. Upon cancellation, your content becomes inaccessible from the Services. We permanently delete content from active systems within 30 days and from backups within 60 days. We cannot recover content once it is permanently deleted, so export anything you need first.
  3. We may suspend or terminate your account and refuse current or future use of the Services for any reason at any time, including violation of these Terms. Verbal, physical, or written abuse of a Company employee or officer will result in immediate termination.

Modifications to the Service and prices

  1. We reserve the right to modify or discontinue, temporarily or permanently, any part of our Services with or without notice.
  2. We may change the price of the Services. If we change pricing for existing customers, we will give at least 30 days notice via the email address on record.

Uptime, security, and privacy

  1. Your use of the Services is at your sole risk. We provide the Services on an "as is" and "as available" basis. We take uptime seriously but do not guarantee uninterrupted service except where a separate service-level agreement applies.
  2. We take measures to protect and secure your data, including encryption of data in transit. Full details, and how to report a security issue, are described in our Privacy Policy and at support@pixeltrace.dev.
  3. When you use our Services, you entrust us with your data, and that of your users. You agree that we may process that data only as described in our Privacy Policy and for no other purpose. For SDK customers, recorded-session data is processed on your behalf; you are responsible for configuring privacy masking and for providing any notices or obtaining any consents your own end users require under applicable law.
  4. We use third-party vendors and hosting partners to provide the hardware, software, networking, and storage required to run the Services. A current list of subprocessors is available on request.

Copyright and content ownership

  1. You give us a limited license to use the content you and your users post solely in order to provide the Services to you. We claim no ownership over your content, and all materials you submit remain yours.
  2. We do not pre-screen content, but we reserve the right (not the obligation) to refuse or remove any content available via the Services.
  3. The Company or its licensors own all right, title, and interest in the Services, including all intellectual property rights. You obtain no ownership rights in the Services through your use. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, SDK, or visual design without our express written permission.

Features and bugs

We design the Services with care, but there is no such thing as a service that pleases everybody, and we make no guarantee that the Services will meet your specific requirements. As with any software, the Services will have bugs. We track reported bugs and work through priority ones, especially security and privacy issues, but we do not guarantee completely error-free Services.

Liability

You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost-profits, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use of, or inability to use, the Services; (ii) the cost of procurement of substitute goods or services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Services; or (v) any other matter relating to these Terms or the Services, whether as a breach of contract, tort (including negligence), or any other theory of liability.

In other words: choosing to use our Services means making a bet on us. We do our best to be a safe bet through careful management of the business and investments in security and infrastructure. If you choose to use our Services, thank you for betting on us.

Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Raleigh, North Carolina, USA.
